Wrongful termination

Pakistan’s wrongful termination law provides remedies to employees who lose their jobs for the wrong reasons.

In Pakistan, most employees are at-will employees, which means their employer can terminate their employment at any time for almost any reason and without warning.

But there are some exceptions to at-will employment in Pakistan’s labor law. If your employer victimizes you in such a way that he fires you in violation of an implied contract or in violation of public policy, you may have the right to compensation.

Pakistani employees have the complete right to be free from wrongful termination (or wrongful failure to promote) if an employer terminates:

  • his or her employment as a form of whistleblowing retaliation
  • his or her employee in violation of the Pakistani Labour Act’s whistleblower protections
  • his or her employment because of the employees’ political speech or activities outside of work
  • his or her employment as retaliation for a qui tam lawsuit
  • his or her employee based on a failure to provide reasonable accommodation to a worker with a disability

Moreover, several provisions of Pakistan’s labor laws prohibit employers from retaliating against employees through negative tactics in addition to termination of employment.

Wage and hour law

According to Pakistan’s labor law, all employers are required to comply with wage laws and provide employees with regular meals and rest breaks.

The employers will also have to pay overtime to the exceptional employees, who work eight (8) hours a day or more than forty (40) hours a week. 

Pakistani employers sometimes try to get out of their wage and hour obligations by misclassifying non-exempt employees as exempt (i.e., classifying hourly employees as salaried). Pakistani employers may also misclassify employees as independent contractors to get around wage and hour laws.

How can you file a complaint or lawsuit against your harasser in Pakistan?

The first step for employees experiencing harassment is to file a complaint with the Office of Ombudsperson, Government of Punjab.
